The terms below contain our data processing commitments on your instruction as a customer and outline our commitments to safeguarding your personal data.

If you are a AuditBase customer and you signed a separate agreement with AuditBase, these terms may be superseded or supplemented by that agreement.
Terms of Service
In these Terms of Service, 'you' refers to you as a user of the website.
'Personal Data' means any information which identifies you personally, such as your name, email address, phone number, or billing information, or other data which can be reasonably linked to such information by AuditBase.
The Website provides information about our company and our software development tools and also provides our customers with the ability to create user accounts to access software for the generation of progress reports for software projects to their customers.
AuditBase processes Personal Data in the course of operating the Website and our business. We are committed to protecting the privacy of personal data. To the extent AuditBase processes Personal Data in the course of operating our business, this Terms of Service sets out how we process Personal Data as a controller or processor. Any capitalized terms that are not defined in this Terms of Service have the meanings given to them in the GDPR and UK Data Protection Laws (defined below).
The Website is not intended for children and we do not knowingly collect data relating to children.
AuditBase will process Personal Data as a controller (defined below) when operating the Website and when processing account information to register, administer and service customer accounts.
AuditBase will process Personal Data as a processor (defined below) on behalf of customers when providing the software to generate progress reports for software projects.
'Controller', 'Processor', 'Data Subject', 'Personal Data', 'processing' (and 'process') and 'special categories of personal data' have the meanings given in the GDPR.
'Customer Data' means any Personal Data that AuditBase processes on behalf of a customer via the Service, as more particularly described in this Terms of Service.
'Data Protection Laws' means all data protection and privacy laws applicable to the processing of Customer Data under the Agreement, including, where applicable, EU Data Protection Laws.
'EU Data Protection Laws' means the GDPR and all laws and regulations of the European Union, the European Economic Area, their member states, Switzerland and the United Kingdom applicable to the processing of Personal Data under the Agreement.
'GDPR' means the General Data Protection Regulation (EU) 2016/679.
'Security Incident' means a breach of AuditBase's security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Customer Data on systems managed or controlled by AuditBase.
'Sensitive Data' means (a) social security number, tax file number, passport number, driver's license number, or similar identifier (or any portion thereof); (b) credit or debit card number (other than the truncated (last four digits of a credit or debit card)); (c) employment, financial, genetic, biometric or health information; (d) racial, ethnic, political or religious affiliation, trade union membership, or information about sexual life or sexual orientation; (e) account passwords; or (f) any other information that falls within the definition of 'special categories of data' under GDPR or any other applicable Data Protection Laws.
'Subprocessor' means any processor engaged by AuditBase or its affiliates to assist in fulfilling its obligations with respect to the provision of the Service under the Agreement. Subprocessors may include third parties or affiliates of AuditBase.
This Terms of Service applies where and only to the extent that AuditBase processes Customer Data that is subject to Data Protection Laws on behalf of the customer in the course of providing the Service pursuant to the Agreement.
The customer acknowledges that regarding the processing of Customer Data, the customer may act either as a controller or processor and, except as expressly provided in this DPA, AuditBase is a processor. AuditBase will process Customer Data in accordance with the customer's instructions as outlined in this Terms of Service.
Customer shall have sole responsibility for the accuracy, quality, and legality of Customer Data and the means by which Customer acquired Customer Data.
